Introduction


Ibdaa Al-Tareeq Car Rental Company aims to provide the highest level of service to customers interested in car rental activities, meeting your expectations and fulfilling your needs. We present these Terms and Conditions; please read and understand them carefully before finalizing the contract. Finalizing the contract signifies your acceptance of these Terms and Conditions. If you do not agree to these provisions and terms, please do not complete the contract. Please also note that some of these provisions and terms may change from time to time according to applicable regulations.

These Terms and Conditions cover all aspects of your relationship with the Company, starting from the booking process and its confirmation, through vehicle delivery and return, and the resulting responsibilities and rights of both parties.

We place utmost importance on protecting your personal data and privacy. Required data, such as name, date of birth, identification information, and driver's license, is collected for the purpose of completing rental operations and providing you with better services. This data is stored under strict protection and is not shared with any external parties except for relevant government entities.

Regarding bookings, all bookings, modifications, and cancellations available through our electronic channels are subject to the Company's approval. The Company reserves the right to refuse, accept, or cancel any booking at its sole discretion and without any liability. The final total rental amount is determined before payment completion, as the amount depends on the vehicle type and additional services requested by the renter, plus the Value Added Tax (VAT) percentage. In the case of cancelling a confirmed and paid booking less than 24 hours before the pickup time, the value of one day's rent will be deducted.

Our terms also include details regarding vehicle use and maintenance. The vehicle is delivered in good condition and free of defects to be suitable for the purpose for which it was rented, and the renter is required to return it in the same condition as received. The renter bears responsibility for any damages resulting from misuse or violation of the contract terms, including repair costs and traffic fines. The renter must immediately inform the lessor of any technical malfunction in the vehicle, or if it is involved in an accident or theft.

The Company provides comprehensive insurance on the vehicles, covering third-party liability as well as the rented vehicle, with payment of the deductible percentage (as specified in the unified contract). However, there are cases excluded from insurance coverage, such as driving under the influence of intoxicants, driving without a valid license, driving by unauthorized persons, using the vehicle for unauthorized purposes, or violating traffic regulations. The renter bears the costs resulting from any damages not covered by the insurance. "According to the insurance policy."

The Company is committed to all government regulations governing car rental activity in the Kingdom of Saudi Arabia, and these Terms and Conditions form an integral part of these commitments.

Terms and Conditions

The following are the general terms and conditions governing the relationship between the Lessor (the Company) and the Lessee. The Lessee's signature on the rental contract constitutes full and binding acceptance of all these clauses.

First: Lessee Requirements and Basic Booking Conditions
These conditions are essential for completing the rental process.

  1. Lessee Eligibility: The Lessee must be at least 23 years old.

  2. Required Documents: The following valid s must be presented:

    • For Citizens: National ID and Driver's License.

    • For Residents: Valid residency permit (Iqama) or Passport showing Border Number and a Driver's License authorized for driving in the Kingdom.

  3. Credit Card: Non-citizen Lessees (Residents and Visitors) are required to present a valid credit card.

Second: Financial Obligations and Payment
These clauses define the financial responsibilities arising from the contract.

  1. Security Deposit Hold (Pre-Authorization):

    • The Lessor has the right to hold a specified amount on the Lessee's credit card as a guarantee to cover any obligations that may arise during or after the contract period.

    • This guarantee includes, but is not limited to: traffic violations, parking fees, additional insurance costs, damage repair costs, or any other fees resulting from a breach of this contract.

    • Deposit Refund: The held amount is automatically released within a maximum period of 21 working days after vehicle return, subject to the policies of the card issuer's bank, provided there are no outstanding dues against the Lessee. If the guarantee is in cash, it is refunded immediately upon vehicle handover and confirmation of its condition with no deductions.

  2. Late Return Fees:

    • One free hour is granted after the vehicle return time specified in the contract.

    • After the free hour expires, a late fee is charged for each additional hour (up to a maximum of 4 hours), with any part of an hour considered a full hour.

    • If the delay exceeds 4 hours, a full day's rental cost is charged.

  3. Extra Kilometers:

    • The daily free distance is 300 kilometers.

    • An additional cost is charged for each kilometer exceeding the allowed limit, according to the price specified in the contract.

Third: Vehicle Use and Return
These clauses explain how to use the vehicle and related obligations.

  1. Purpose of Use: The Lessee acknowledges that their use of the vehicle is limited to personal transportation only.

  2. Vehicle Condition upon Return: The Lessee is obligated to return the vehicle on the date, time, and place specified in the contract, in the same operational condition as it was received.

  3. Adding an Additional Driver: The Lessee has the right to add another driver to the contract, provided they meet the insurance conditions, to be included in the insurance policy.

  4. Prohibition of Modifications: The Lessee is not entitled to make any modifications or tamper with the vehicle's structure or components and will bear the cost of repairing any modifications or damages resulting from them.

  5. Key Loss: In case of losing the vehicle key, the Lessee bears the cost of the new key according to the authorized dealer's price list, plus an administrative fee of 250 SAR and any other resulting damages.

  6. Interior Damages: In case of any damage to the interior upholstery or parts of the vehicle cabin, the Lessee is obligated to pay the cost determined by the Lessor or based on an official estimate.

Fourth: Insurance and Accident Coverage

  1. Conditions for Insurance Validity: For insurance coverage to be valid, the following conditions must be met:

    • Immediate notification of the Lessor and security authorities upon the occurrence of an accident or theft, and submission of the official accident report and all required s.

    • The driver must meet the terms and conditions of the insurance policy approved in the Kingdom of Saudi Arabia.

  2. Cases Excluded from Insurance Coverage: The Lessee bears full responsibility for damages caused to the Lessor's vehicle or to third parties in the following cases:

    • If the driver was under the influence of intoxicants or narcotics.

    • If the driver is not authorized to drive under the contract (a driver other than the Lessee or the registered additional driver).

    • Theft of the vehicle resulting from the Lessee's negligence, including but not limited to (leaving it running).

    • Damages resulting from serious traffic violations such as: running a red light, driving against traffic, drifting (Tafheet), or any use indicating negligence and recklessness.

    • Using the vehicle to push or tow other vehicles.

Fifth: Maintenance and Breakdowns

  1. Lessor's Responsibility: In the event of a technical malfunction in the vehicle not caused by misuse or negligence by the Lessee, the Lessor is obligated to replace it with a vehicle of the same category. If unavailable, a higher category vehicle will be provided at no extra cost, or a lower category vehicle with the price difference refunded to the Lessee.

  2. Lessee's Responsibility:

    • The Lessee must return the vehicle to the Lessor when scheduled maintenance is due or to repair any breakdown.

    • The Lessee is prohibited from performing any maintenance or repairs on the vehicle themselves or at external workshops.

Sixth: Lessor's Right to Recover the Vehicle and Terminate the Contract
The Lessor has the right to take necessary measures to recover the vehicle immediately through the competent authorities and at the Lessee's expense, in the following cases:

  1. Delay in Return: If the Lessee delays returning the vehicle for more than 24 hours from the specified time without obtaining approval for an extension.

  2. Providing Incorrect Information: If it is proven that the Lessee provided false data or information when signing the contract. In this case, the Lessor has the right to notify the competent authorities that the vehicle is deemed stolen.

  3. Violation of Usage Terms: When the vehicle is used in a manner violating the agreed contract clauses.

 

Seventh: Cancellation or Modification Policy

1. Scope of Application
This policy applies to all reservations made through the website, mobile application, phone, or direct branches of Ibdaa Al-Tariq Company.

2. Reservation Cancellation

a. Notification Periods and Fees

  • Cancellation 48 hours before pickup time:
    Full refund of the amount paid, except for the fixed service fee (100 SAR).

  • Cancellation between 24-48 hours before pickup time:
    One day's rental value and the fixed service fee (100 SAR) will be deducted from the total reservation.

  • Cancellation within less than 24 hours before pickup time, or no-show without notice:
    Two days' rental value and the fixed service fee (100 SAR) will be deducted from the total reservation.

b. Free Cancellation Cases

  • Force majeure (such as natural disasters or government decisions) that prevent vehicle pickup.

  • Death of a first-degree relative of the customer.
    An official proving the situation must be submitted within 72 hours of the cancellation date.

c. Notification Procedures
The customer can submit a cancellation request through:

  • Contacting customer service center: 920006797

  • Visiting any branch and filling out the "Reservation Cancellation Request" form.

d. Refund Method

  • Refunds will be processed through the same original payment method within 7-10 business days or bank transfer.

3. Reservation Modification
The customer is allowed to modify:

  • Pickup or return date with a maximum of 15 days.

  • Rental period can be extended based on availability and after payment of the amount.

  • Vehicle type can be changed (subject to category availability).
